Privacy Policy

The Galavante Group LLC ("Galavante") provides the galavante.com website (the “Site”) and related services. Since the success of the Site and Site-related services depends on building and maintaining goodwill with customers, Galavante is committed to implementing measures designed to protect the privacy of those who visit the Site and use the Site-related services. Moreover, Galavante desires to set examples and help establish the standards for privacy on the Internet.

Although Galavante respects the privacy of all those who visit the Site and use the Site-related services, Galavante collects information from its visitors and members. This privacy policy (“Privacy Policy”) governs your interaction with the Site and registration for and use of the Site-related services.  Except as otherwise expressly set forth in this Privacy Policy, Galavante’s Terms of Service and other published guidelines, Galavante does not release personally identifiable information about its visitors and members without their permission.

Please note that Galavante reviews its privacy practices from time to time, and that the practices set forth herein are subject to change.  Galavante therefore asks that you bookmark and periodically review this page to ensure continuing familiarity with the most current version of Galavante’s Privacy Policy.  In addition, your continue use of the Site and Site-related services will constitute your acceptance of any changes or revisions to this Privacy Policy.  Registered users may also be notified via email of changes to the Privacy Policy or if the use of information collected by the Site is changed. To contact Galavante about privacy issues or to report an actual or alleged violation of this Privacy Policy, please email Galavante at legal@galavante.com.

The two types of information that Galavante gathers about users

(1) Non-personally identifiable information

When visitors come to the Site, Galavante collects and aggregates information indicating, among other things, which pages were visited, the order in which they were visited and which links were "clicked."  Collecting such information involves the logging of your IP address, operating system and browser software.  Although such information is not personally identifiable, Galavante can determine from your IP address your Internet Service Provider and the geographic location of your point of connectivity. The non-personally identifiable information that Galavante collects helps Galavante identify the most popular areas of the Site and determine the effectiveness of Galavante’s promotional activities. In addition, Galavante may disclose some of this aggregated, non-personally identifiable information to Galavante’s advertisers to inform them of the number of visitors who have seen and/or clicked through their advertisements. (See "How Galavante uses and does not use non-personally identifiable information" below.)

Similarly, Galavante uses "cookies" – that is, small text files placed on your computer’s hard drive – to help Galavante determine the type of content and sites to which you link, the length of time you spend at any particular area of the Site and the Site-related services that you choose to use.  Cookies also tell Galavante which advertising you have seen on the Site.  Essentially, cookies are your identification cards for the Galavante computers or servers that delivered the advertising to you.  In addition, cookies are only read by the server that placed them and are unable to execute any code or virus.

Furthermore, cookies allow Galavante to serve you better and more efficiently, and to personalize your experience at the Site.  Nevertheless, you should be able to control how and whether cookies will be accepted by your web browser.  For more information on how to do so, you should refer to the documentation accompanying your browser.  If you disable the cookies feature of your browser, there will be no effect on the usage of your computer or your access to Site.

Please further note that some of Galavante's third party advertisers and advertising services providers may place cookies on your computer's hard drive in order to provide you with banner and other types of advertising that may be of interest to you while you are visiting the Site. Galavante cannot and does not assume any responsibility for the actions or information collection practices of such third party advertisers or advertising services providers.

(2) Personally identifiable information

In certain areas of the Site – for example, when registering to become a Galavante member or user of a Site-related service – Galavante requests that you provide Galavante with personally identifiable information (including, for example, first name, last name, email address, gender, birthday, address, city and state).  Galavante also requests information regarding your interests. Galavante does not at this time, however, request credit card information.  (See “How Galavante uses and does not use personally identifiable information” below.)

The Site and Site-related services are not directed towards anyone under the age of 18.  Further, Galavante does not knowingly collect personal or personally identifiable information from anyone under the age of 18, and anyone under the age of 18 is expressly prohibited from using the Site and related services.

In addition, Galavante does not control the acts of its members or visitors.  All members and visitors should be aware that, when they disclose personally identifiable information in a chat room or other forum or public area of the Site, the information may be collected and used by others for the purposes of distributing unsolicited communications to you or to others outside the Site.  You should therefore be careful to use your discretion when disclosing any information online, including, for example, your last name, first name, age or other identifying information, because you may be disclosing such information to the public.

In the event that you encounter any Galavante user who is or may be improperly collecting or using information about you or other users of the Site or Site-related services, please email Galavante at [webmaster@galavante.com].

How Galavante uses and does not use the information that it gathers

Please take some time to familiarize yourself with the different ways that Galavante uses the information that it gathers.  Keep in mind that, while Galavante encourages all third parties involved – including, but not limited to, its affiliates and advertisers – to adhere to Galavante’s policies regarding the privacy of its visitors and members and to otherwise handle personal information in a responsible manner, Galavante cannot and does not assume any responsibility for any actions or omissions of such third parties, including the manner in which they use information received either from Galavante or independently.  Nevertheless, in the event that you encounter any third party associated with, or who claims association with, Galavante that you feel is improperly collecting or using information about you, please email Galavante at legal@galavante.com;  Galavante would be happy to forward your message to the third party.

(1) How Galavante uses and does not use non-personally identifiable information

Galavante uses non-personally identifiable information in aggregate form to build higher quality, more useful Site-related services by performing statistical analyses of the collective characteristics and behavior of Galavante’s members and visitors, and by measuring demographics and interests regarding specific areas of the Site.  Galavante provides statistical information based on this data to advertisers, affiliates and other current and potential business partners.  Galavante also uses such aggregate data to inform said third parties as to the number of people who have seen and clicked on links to said third parties’ websites.

The Site contains links to other websites, including advertisers’ websites or other affiliated websites, which may or may not be owned or operated by Galavante. Unless otherwise expressly indicated, Galavante is not responsible for the privacy practices or the content of any third party website, including any such website’s use of any information (including, for example, IP address, browser type or operating system) collected when visitors to such website click through any link to such website. Even though such information might not identify you personally, Galavante strongly encourages you to become familiar with the privacy practices of third party websites.

(2) How Galavante uses and does not use personally identifiable information

Galavante provides notice to potential Galavante registrants that personally identifiable information will be collected during the registration process. Such notice is provided simultaneously with your Galavante registration;  moreover, this Privacy Policy itself serves as notice that such information is collected under those circumstances. Galavante uses personally identifiable information (including, for example, gender, birthday and interests) to improve the quality and usefulness of the Site-related services by developing general user profiles, geographic user profiles and personalizing the Site-related services.  Although you may not "opt out" of the registration process if you wish to become a Galavante member or user of the Site-related services, you may choose to "opt out" of receiving certain materials (including, for example, the Galavante email newsletter and emails from third party advertisers) by unclicking the box on the registration page for such materials.  If you have chosen to receive, or do not "opt out" of receiving, said certain materials, Galavante reserves the right to release any personally identifiable registration information regarding you to third parties who provide goods or services that Galavante believes may be of interest to you.

Galavante limits its own solicitations (including, for example, the Galavante email newsletter) to those customers who have chosen to receive, or who have not "opted out" of receiving, such solicitations.  Said solicitations are limited in that they, among other things, will clearly indicate the originator of the email and provide the customer with a method of choosing to receive such communications or "opting out" of receiving future communications of a similar nature.  In addition, Galavante sometimes uses individual data to "target" advertising — to decide which advertisements and sponsor messages to show to which members.  As an example, if Sponsor Co. wishes to display its advertising only to female Galavante members, Galavante uses member registration data to ensure that Sponsor Co.'s advertising is displayed only to female members.

Galavante may use individual members' data to "pre-populate" forms which are displayed for the purpose of collecting individual data by Galavante and/or its sponsors. In no event does pre-populating a form automatically transfer any data to any advertiser or third party. Only if the member voluntarily requests that such data be transferred will any transfer take place — for example, if and when a member clicks a "submit form" button or other button.  However, Galavante reserves the right, however, to disclose information contained within its access logs concerning any visitor or member as Galavante reasonably feels is necessary to protect its systems or business. Specifically, but without limitation, Galavante reserves the right to disclose such information when a visitor or member is in violation of Galavante’s Terms of Service or other published guidelines, or partakes or is reasonably suspected of partaking in any illegal activity, even without a subpoena, warrant or other court order, and to disclose such information in response to court and governmental orders, civil subpoenas, discovery requests and as otherwise required by law.  Galavante cooperates with law enforcement agencies in identifying those who may be using Galavante’s servers or services for illegal activities.  Galavante also reserves the right to report any suspected illegal activity to law enforcement for investigation or prosecution or to suspend or terminate your membership in connection with any suspected illegal activity.

Finally, if and when Galavante sponsors promotions or sweepstakes, or third parties sponsor promotions or sweepstakes in conjunction with Galavante, either Galavante or the third party will post relevant privacy information in the official rules and/or registration area for the promotion or sweepstakes. The foregoing privacy information, to the extent that it conflicts with this Privacy Policy, will govern the particular promotion or sweepstakes.

Changing or deleting personal information

If you would like to have your personally identifiable information removed from Galavante's database, please email Galavante at webmaster@galavante.com;  Galavante will use reasonable efforts to comply with your request. Corrections, such as, name or address changes, can be made by emailing same to Galavante at webmaster@galavante.com.  Please keep in mind, however, that there will be residual information that will remain within Galavante’s databases, access logs and other records, which may or may not contain such personally identifiable information. The foregoing residual information will not be used for commercial purposes; however, Galavante reserves the right, from time to time, to recontact former customers or users of the Site and Site-related services.

Galavante takes every precaution to protect its users’ information.  When a user submits sensitive information via the Site, the user’s information is protected both on- and off-line.

Galavante does everything in its power to protect user information.  Access to all of Galavante’s users’ information is restricted in Galavante’s offices.  Only key top-level personnel who need the information to perform a specific job are granted access to personally identifiable information.  All computers in Galavante’s offices are equipped with passwords as are all internal systems. In addition, all employees are kept up-to-date on Galavante’s security and privacy practices. Every quarter, as well as any time new policies are implemented, Galavante’s employees are furthermore notified and/or reminded about the importance that Galavante puts on privacy and what they can do to ensure that users’ information is protected. Finally, the servers that Galavante stores personally identifiable information on are kept in a secure environment.

If you have any questions about the security at the site, feel free to email your questions to webmaster@galavante.com.

If you have any questions regarding any aspect of this Privacy Policy, please email Galavante at legal@galavante.com.  Galavante would welcome your questions or feedback.
