* Galavante does not assume any risk, liability or responsibility for the authenticity or the authorship of any tangible property, services or experiences identified in the auction program. The items are represented to the best of our knowledge.
* All items, property and services are auctioned "as is." We do not make any representations or warranties of any kind or nature, expressed or implied, with respect to the auction items, property, services or experience.
* The highest bidder acknowledged by the auctioneer shall be the winning bidder/final purchaser. In the event of a dispute between bidders, the auctioneer has the sole and final discretion to determine the successful bidder.
* At the decision of the auctioneer, the winning bidder shall be deemed to have purchased the offered lot subject to all the conditions set forth herein and thereupon (a) assumes the risk and responsibility of the purchased lot, and (b) will pay the full purchase price/winning bid.
* Some auction items have expiration dates. Galavante is not responsible if the winning bidder fails to use an auction item before the expiration date. Please bid accordingly. There will be no refunds or exchanges.
* Some services and/or experiences being auctioned may require the winning bidder to agree to a waiver of liability when redeeming. Galavante is not a representative of the service or the experience and cannot guarantee, release nor assume the waiver for the winning bidder. Please bid accordingly. There will be no refunds or exchanges for any errors in bidding for services and/or experiences you may not or cannot redeem.
* All winning bids are final and will become the proceeds of the Charity Auction. There will be no refunds or exchanges.
* For the Winning Bidders: an auction payment qualifies as a charitable contribution deduction only to the extent that it is shown to exceed the fair market value of any consideration received in the form of privileges or other benefits. We will not be providing you with a charitable donation receipt. We advise you to consult your tax advisor regarding deductibility of your purchase and any other tax questions.
* By participating in this charity auction, each donor and bidder agrees to indemnify and hold harmless Galavante, and its officers, employees and agents, from any liability arising, directly or indirectly, in connection with the auction. Each donor and bidder recognizes and agrees that neither Galavante nor agents who assist in conducting this auction shall be liable for any negative results from the use of auctioned items, services and/or experiences.
